Responsible Use Agreement

ColdConvert is an outreach platform for healthcare staffing agencies. You, the Customer, are the sender of record for every outbound message. You are responsible for the lawfulness, accuracy, and appropriateness of your campaigns.

1. What you confirm

By using ColdConvert you confirm that you have a lawful basis to contact each recipient you upload, that you will honor opt-outs immediately, that you will not upload protected health information, and that you will follow CAN-SPAM, TCPA, state telemarketing laws, and carrier rules applicable to your campaigns. ColdConvert provides controls; you provide the legal posture.

2. What ColdConvert is not

ColdConvert is not a HIPAA-covered service. ColdConvert is not BAA-eligible. ColdConvert does not provide certification of compliance with CAN-SPAM, TCPA, state telemarketing laws, or carrier rules. ColdConvert is not a substitute for legal review of your outbound program by your attorney.

3. What ColdConvert enforces before send

Verified sending domain, STOP/HELP automatic response, recorded opt-in tracking, suppression list across all future sends, bounce and complaint auto-pause, quiet-hours gating, PHI marker scanning. These are operational controls, not legal warranties.

4. AI-generated content

ColdConvert may generate suggested message variants. You retain the responsibility to review, edit, and approve each variant before launch. Generated content does not constitute legal or compliance advice. AI voice calls self-identify as AI in the first ten seconds.

5. Data you upload

You may upload your own candidate and facility contact data. You confirm you have rights to use and contact each upload. ColdConvert does not knowingly accept patient data, clinical records, or other protected health information. Outbound message bodies are scanned for PHI markers and blocked when detected.

6. Acknowledgement

By accessing the ColdConvert Workspace you acknowledge that you have read this Agreement and that your continued use constitutes acceptance. A clickwrap acknowledgement is recorded with timestamp, IP, user-agent, and a SHA-256 hash of the agreed document version.
